Special Meeting of the Board of Education was called to order by President Carol Carstensen at 5:14 p.m.
MEMBERS PRESENT: Carol Carstensen, Bill Keys, Lawrie Kobza, Juan José López (arrived 5:57 p.m.), Ruth Robarts, Shwaw Vang, Johnny Winston, Jr.
MEMBERS ABSENT: None
STAFF PRESENT: Attorney June Wilson, Barbara Lehman-Recording Secretary

Ruth Robarts returned at this time. Student Representative Connor Gants joined the meeting.
June Wilson left and other staff joined the meeting at this time: Sue Abplanalp, Rita Applebaum, Mary Gulbrandsen, Marianne Moss, Bob Nadler, Roger Price, Joe Quick, Art Rainwater, Loren Rathert, Linda Sweeney.
The Superintendent distributed a staffing summary for 2005-06 (a copy is attached to the original of these minutes).

4. MMSD Administrator Contracts
5. MMSD Non Union Professional Positions
(Packets included a spreadsheet showing administrator salary information for 2005-06; a spreadsheet showing non-union professional hours and annual salary rates. Copies are attached to the original of these minutes.)
The Superintendent reviewed the chart of Administrative Positions from 1998/99-2003/04 and the staffing summary. He noted that there was one Administrator difference and that they would try to reconcile that. The Non-Union Professionals do not have a contract. Everyone else is at-will or in the Union and others are confidential.
Discussion: Differences between one- and two-year contracts. All contracts renew if no Board action by the end of January. Nonrenewal would not apply until five months before the contract is up. Only exception would be performance based. These are rolling two-year contracts. A letter is sent in March asking administrators if they want to extend. The January deadline does not impact that. That is policy.
Juan José López arrived at this time.
He noted that he had one copy of Human Resources Policy 2.06.
Discussion continued: The policy talks about doing it in the spring. If the Board were to consider some type of reduction-in-force, what would it do? Target the positions then instead of sending out an extension, send a notification to them saying that we will not be extending at this time. What if that were done in the spring? If in July, could be we send it then? Yes. Should the Board receive information that all administrators have satisfactory performance before the contracts are extended? The Superintendent would not extend the contract. There have been people who have been put on one-year contracts if there are performance issues. All evaluations should be completed by the end of the fiscal year. Nothing in the contract about two-year rolling; not a Board policy. Law gives the district the right to ask them. Departments have been eliminated and notices of non-renewal have been issued in the past several times. Administrators have a right to hearings. Depending on the reason, and if no Board action is taken, the Board can still look at a policy relative to those positions that are covered by the statute and those that are not. Keeping policy choices open as the Board goes through the budget. Uncertain whether a contract can be voided. Issues can be addressed before extensions are issued in the spring.
Affects on staff morale. Affects on hiring. Direction of the majority of the Board. Competitive hiring packages.
It was suggested that these issues be taken up at another meeting due to time constraints.
It was moved by Ruth Robarts to adjourn the meeting. There was no second and the motion died.
Discussion continued: Decision not necessary tonight. Administrators have been under this practice. Board should not decide about renewing positions. Putting administrators who are not covered by the statute and guaranteed two years on a footing that is similar for less senior people; need to look at functions. That is why administration comes to the Board in January with information about positions that they recommend. Protecting people in the schools. Number of positions that could be reduced is about 7 or 8. Non-Union Professionals have been getting treated like administrators. Nothing in the contract about rolling two-year extension and nothing in the statute that says the Board has to do that. Human Resources policy says spring. Give Board the flexibility to make decisions. Wrong way to approach cutting the budget; need legal advice. Micromanagement; will not fix the budget.
