The District shall follow federal regulations, state statutes, administrative rules and city ordinances governing communicable diseases, as well as Madison Department of Public Health procedures and the Health Services Guidelines regarding communicable diseases.
The Health Service Guidelines are approved by the Madison Metropolitan School District's medical advisor, as follows:
- No employee shall refuse to perform his/her duties or refuse to work with or provide services to students or staff because they have, or may have, a communicable disease, if the communicable disease does not pose a significant health risk to others. The determination of whether a communicable disease poses a health risk to others shall be made by the Health Services Coordinator (or designee) in accordance with the Health Services Guidelines. Said determination shall be based solely on the available medical evidence.
- Employees who have a communicable disease, as defined by the Health Service guidelines or HSS Administrative Rule 145, that may expose others to significant risk while they perform their duties, will be excused from work until they no longer pose the health risk. The Superintendent or his/her designee shall notify the employee in writing that s/he shall not participate in school-related activities or be present on school premises until s/he no longer poses the health risk to others.
- Employees who provide services or perform duties that expose them to a significant health risk may be excused by the District from providing that service or performing such duties until they are no longer exposed to a significant health risk. During the excused time, the employee will be reassigned to other duties.
Again, the determination of whether the employee is exposed to a significant health risk shall be made by the Superintendent or his/her designee upon the recommendation of the Health Services Coordinator (or Coordinator's designee).
If an employee has a personal health problem which s/he believes should be a consideration in the decision to exclude under this section, the employee must inform the District Health Services of the personal health problem.
