It is the policy of the Board to encourage its employees to develop intellectual property.* Should an employee(s) develop such property during time periods when s/he is being paid by the Board and during time periods when such employee is not being paid by the Board, the Board agrees to waive its rights under the copyright law relative to the property, provided that such employee makes available to the Madison Metropolitan School District copies of the property at no cost. This policy does not apply when an employee develops the intellectual property during time periods when the employee is exclusively working on the project while being paid by the Board. Under these conditions, the property developed would become the property of the Board.

Should an employee of the Board develop intellectual property in the manner set forth above, the employee or the employee union representative, should contact the Superintendent or the Madison Metropolitan School District Legal Counsel. On behalf of the Board, Legal Counsel and/or the Superintendent will have the authority to negotiate an agreement with the employee union representative and the employee that is in the spirit of the policy. If an agreement is not reached, the employee and/or the union representative may appeal to the Board for further consideration of the matter.

* Intellectual property is defined as the creation of written documents, computer software, or other teaching equipment that may be published and/or produced for public sale.
