Subject: LIMITED TERM EMPLOYMENT (LTE)

The Madison Metropolitan School District hires a variety of limited term employees. It is important to establish consistent practices that comply with the applicable collective bargaining agreement, wage and hour laws and IRS regulations. All limited term hires must be processed through the Department of Human Resources on the Limited Term Employment form prior to the employee commencing work. This policy does not cover individuals who are independent contractors paid through accounts payable.

Collective Bargaining Agreements

An LTE assignment which is clerical in nature is covered by Addendum C of the SEE Collective Bargaining Agreement. An LTE assignment that consists of work normally performed by an educational assistant is covered by Addendum A of the EA Collective Bargaining Agreement. Teachers who work "extra duty assignments" are covered by the extra duty compensation schedule and Addendum D of the Teacher Collective Bargaining Agreement.

Assignment of Current Employees to Limited Term Employment

Whenever a current MMSD employee is asked to temporarily increase his/her hours to perform LTE work, it is necessary to review the applicable collective bargaining agreement to determine the rate of compensation and if benefit levels are affected by the temporary increase in hours of work. In general, an employee will retain his/her current rate of pay for the additional hours unless the contract specifies a different rate of pay for the extra assignment (for teacher positions, refer to the extra-duty compensation schedule in the Teacher Collective Bargaining Agreement).

Whenever there is special one-time project work that is not listed in the extra duty compensation schedule, the hiring authority shall contact the Employment Manager to establish the rate of compensation prior to making an offer of employment.

Examples of limited term "special one-time project" work that are sometimes offered to current teachers include, but are not limited to, the following:

Hiring New Employees for Limited Term Employment

A new LTE hired to perform work that is clerical in nature shall be compensated in accordance with Addendum C of the SEE Collective Bargaining Agreement. A new LTE hired to perform educational assistant work shall be compensated in accordance with Addendum A of the EA Collective Bargaining Agreement.

Whenever there is limited term employment work that does not fall within the scope of duties performed by either represented clerical classifications or educational assistant classifications, or the extra duty compensation schedule of the Teacher Collective Bargaining Agreement, the hiring authority shall consults with the Employment Manager to determine the appropriate rate of compensation, based upon the duties and required qualifications, prior to making an offer of employment.

MMSD Students

MMSD students who are hired as LTEs are usually compensated at minimum wage. Students may be hired at a rate higher than minimum wage with the prior approval of the Employment Manager.
