Overtime compensation for employees covered by the Custodian and Supportive Educational Bargaining Units is regulated by specific provisions found in the applicable labor agreements and by provisions of the federal Fair Labor Standards Act.

Labor Contract Provisions

A. Custodians

Overtime shall be defined as work performed outside an employee's regular full-time schedule (40 hours per week). All such time will be paid for at the rate of one and one-half the hourly rate. Employees may, however, by mutual consent with the employer, take compensatory time off for overtime worked at the time and one-half rate, provided such time is taken within four pay periods following the pay period in which it was earned.

In the alternative, employer-approved compensatory time may be taken at a mutually agreed upon time when school is not in session, provided it is taken within the calendar year. Requests for compensatory time to be taken during non-student days will not be unreasonably denied.

B. Supportive Educational Employees

Overtime shall be defined as hours of work in excess of 7 3/4 hours per day or 38.75 hours per week. Compensation for all such time worked will be paid for at the rate of one and one-half the hourly rate, except for employees who work on Sunday. When overtime is performed on a Sunday, the employee will be compensated at twice the hourly rate.

Employees may, however, by mutual consent with the employer, take compensatory time off for overtime worked at the time and one-half rate or double rate, whichever is applicable, provided such time is taken within the time allowed by law. Employees holding two positions within this collective bargaining unit will waive their right to receive overtime compensation as herein provided.
