Affirmative Action

It is the policy of the Madison Metropolitan School District to take Affirmative Actions to achieve Equal Employment Opportunity in all personnel actions and procedures, including, but not limited to, recruitment, hiring, training, transfers, promotions, compensation, and other benefits.

This policy is to be administered not only without prejudicial and discriminatory regard to any protected status which includes but is not limited to race, creed, color, disability, national origin, sexual orientation, gender identity, gender expression, religion, age and sex, but special efforts in recruitment and employment shall be taken to overcome inequities of employment of personnel resulting in deficiencies of minorities. These inequities are the result of various negative historical influences which are perpetuated due to a lack of affirmative policies to correct them.

[NOTE: The City of Madison defines gender expression in Madison City Ordinance Sec. 3.23 (2)(t) as follows:

Gender Identity is the actual or perceived condition, status or acts of 1) identifying emotionally or psychologically with the sex other than one's biological or legal sex at birth, whether or not there has been a physical change of the organs of sex; 2) presenting and/or holding oneself out to the public as a member of the biological sex that was not one's biological or legal sex at birth;

This means that gender identity refers to an individual's fundamental sense of themselves as being male or female, masculine or feminine. Gender identity does not always correspond to biological sex.

The City of Madison's Ordinance Sec. 3.23 (2)(t) continues its definition of gender identity with an explanation of what is referred to as gender expression.

3) lawfully displaying physical characteristics and/or behavioral characteristics and/or expressions which are widely perceived as being more appropriate to the biological or legal sex that was not one's biological or legal sex at birth, as when a male is perceived as feminine or a female is perceived as masculine; and/or4) being physically and/or behaviorally androgynous.

This means that gender expression refers to the things like clothing and behavior that manifest a person's fundamental sense of themselves as masculine or feminine, and male or female. This can include but not be limited to dress, posture, hairstyle, jewelry, and vocal inflection.]

This policy allows categorical flexibility regarding age and/or sex where such factors are shown to be valid occupational qualifications in the spirit of Affirmative Action.

It shall be the responsibility of the SUPERINTENDENT of the Madison Metropolitan School District to implement this POLICY in accordance with the Affirmative Action Plan adopted by the BOARD.

The POLICY is to be implemented by all administrative personnel and/or directors and other personnel officers carrying responsibility for these personnel functions. Each department head, (central administration) line officer, principal, and supervisor is to assume responsibility and accountability for this POLICY by providing specific and exemplary leadership and by reporting actions taken to implement this POLICY to the Affirmative Action Officer.

It shall be the responsibility of the Affirmative Action Officer to, as liaison, report progress, problems, and areas of need to the SUPERINTENDENT in the implementation of this POLICY.

Additionally, the purchasing procedure of the Madison Metropolitan School District will be monitored and audited so as to promote equal employment opportunity among its suppliers of goods and services.
