| POLICY | USE OF MMSD ATHLETIC EQUIPMENT AND APPAREL BY STUDENTS | 4605 Pupils |

It is the policy of the Board to allow student athletes who are on an MMSD interscholastic athletic team to use MMSD athletic equipment and apparel in training or non-school competition outside the designated school season of a sport. Student athletes may be allowed to use such equipment/apparel in accordance with the procedure that is set forth below.

The written approval is required of the head coach of the team in which the student athlete participates, as well as the Athletic Director, at the school in which the student athlete participates in the sport.
The student athlete and his/her parent/guardian are responsible for the return of the equipment/apparel in proper condition by a time designated by the coach or the full replacement cost(s) of the item(s) should they not be returned in proper condition by the designated time. The student athlete and his/her parent or guardian shall sign the MMSD Athletic Equipment Use Agreement in which they agree to be responsible for returning the equipment/apparel in proper condition by a time designated by the coach or pay the District full replacement cost(s) of the item(s).
The student athlete and his/her parent agree to hold the MMSD harmless and defend the MMSD, its Board, Board members, officials, officers, employees and agents from any and all legal and equitable rights and claims of any kind whatsoever arising out of or relating to the student athlete's use of the athletic equipment/apparel and shall sign the MMSD Hold Harmless and Indemnification Agreement that reflects their commitment to hold the MMSD harmless and defend the MMSD as described above.
Any student athlete who fails to return the equipment/apparel in proper condition by the date set by the head coach or fails to reimburse the MMSD for the full replacement cost(s) of the item(s) will be declared ineligible for any and all athletic competition until the equipment/apparel is returned in proper condition or full reimbursement is made.
Any student athlete who fails to return the equipment/apparel in proper condition by the designated time or fails to reimburse the MMSD for the full replacement cost(s) of the item(s) shall forfeit the right to use the equipment/apparel in this fashion in the future.
