Operation

It is the policy of the BOARD to accept grants, bequests, contributions, donations and other types of gifts that are for the benefit of the District, its employees or students if there is no basis for not accepting such grant, bequest, contribution, donation or other type of gift as determined by the BOARD.

Operation

The BOARD may, in its discretion, approve or refuse any grant, bequest, contribution or other type of gift for any reason. However, prior to the BOARD making a decision on any bequest, contribution or other type of gift to fund the hiring of a person as a District employee, or in an amount of $10,000 or more, the following procedure shall be followed. Hereinafter, a bequest, contribution or other type of gift to fund the hiring of a person as a District employee, or in an amount of $10,000 or more is referred to as a "donation."

The SUPERINTENDENT or his/her designee shall review all donations taking into consideration, on a case-by-case basis, the following criteria:

  1. The benefit the donation will provide to the District, an individual school, students, employees or the community.
  2. Whether accepting the donation will be in conflict with BOARD Policy, the mission of the District or the District's curriculum and/or instructional program.
  3. Whether accepting the donation is consistent and compatible with District and BOARD priorities and educational objectives.
  4. Whether accepting the donation will cause unanticipated consequences, including on-going annual expenses for the District.
  5. Whether the donation will create a significant inequity and/or competitive advantage among schools, students, District programs, employees or facilities.
  6. The effect the acceptance of the donation will have on the District, individual schools, students, employees and the community.
  7. The District's ability to provide the benefit to the District, individual schools, students, staff, or the community without the donation.
  8. The fiscal condition of the District and any financial limitations of the District.

Based upon this review, the SUPERINTENDENT or his/her designee shall provide to the BOARD a recommendation as to whether or not the BOARD should accept the donation, and the basis for such recommendation. As part of the recommendation, the SUPERINTENDENT or his/her designee shall advise the BOARD whether, in the SUPERINTENDENT'S opinion, the donation will create a significant inequity and/or competitive advantage, and if so, what the BOARD could do to alleviate the significant inequity and/or competitive advantage in the event the donation is accepted. The opinion of the SUPERINTENDENT as to whether or not the donation will create a significant inequity and/or competitive advantage shall be based upon whatever criteria and/or rationale the SUPERINTENDENT deems appropriate. The BOARD, after considering the SUPERINTENDENT'S recommendation, may approve or refuse a donation for any reason. Should the BOARD approve a donation that could create a significant inequity and/or competitive advantage, among schools, the BOARD may consider such donation and the significant inequity and/or competitive advantage potentially caused by it when allocating or reallocating District funds and resources as part of its regular budget process or as an amendment to the budget.

Nothing in this procedure shall be construed to limit the SUPERINTENDENT or his/her designee from negotiating with a donor to resolve any concerns the SUPERINTENDENT has about accepting a donation. However, if the SUPERINTENDENT'S concerns cannot be addressed, the SUPERINTENDENT shall nevertheless submit the donation and his/her recommendation on the donation to the BOARD for action.

If the BOARD approves a donation, the District shall enter into a written agreement with the donor which shall require, among other things, that the donation be given to the District prior to the District expending any funds relative to such donation.

If the BOARD approves a grant, bequest, contribution, donation or other type of gift, the SUPERINTENDENT or his/her designee shall be responsible for (1) distributing and/or the administering the grant, bequest, contribution, donation or gift and (2) ensuring that, in accordance with the action of the BOARD, that any conditions are met.
