The Board may approve leases or agreements for the placement of telecommunication facilities on school property when it is determined to be in the best interest of the MMSD.

The factors the Board shall consider in the evaluation of leases or agreements (hereinafter "agreement") include, but are not limited to, the following:
- The length of the agreement, the ability of and procedure for the MMSD to terminate the agreement and the right of the MMSD to renegotiate the agreement.
- The compensation paid to the MMSD.
- The size of the site subject to the agreement and the ability of the MMSD to benefit from co-location agreements.
- The vendor's rights to assign or to subcontract the agreement and the necessity of the MMSD's consent before an assignment or subcontract can occur.
- The terms and conditions of the vendor's access to school property and the consent of the MMSD required before the vendor can access school property.
- The impact of the installation and operation of a telecommunications facility on school property, including the impact on the health, safety and security of MMSD pupils, staff and visitors to MMSD schools, and the impact on adjacent neighborhood residents and property.
- The responsibility for maintenance of the site and grounds adjacent to the site of the telecommunications facility and the vendor's responsibility to restore the site to its original condition when the telecommunications facility is removed.
- The insurance required by the vendor and the MMSD.
- The remedy available to the MMSD if the vendor defaults on the agreement.
- The MMSD's right to indemnification for the liability arising from the installation, use, maintenance, repair or removal, etc. of the telecommunications facility.
- The vendor's responsibility and ability to pay for utility charges for electricity, telephone, and any other utility used or consumed and to pay all fees and charges in obtaining federal, state or local approvals for the placement on and operation of a telecommunications facility on school property.
- The vendor's requirement to comply with all federal, state, county and city laws, ordinances, rules or regulations now or hereafter enacted by any governmental authority or administrative agency having jurisdiction over the site and the MMSD operations, including all Federal Communications Commission guidelines for radio frequency exposure levels.
- The requirement of the vendor to participate in the community processes associated with notifying and coordinating the provision of information to the MMSD community and neighborhoods that are nearby and adjacent to the site.
