Liability Insurance

  1. Assault and/or Battery Cases:
    1. Teachers shall report all cases of assault and/or battery suffered by them or caused by them in connection with the teacher's employment on forms provided by the BOARD. These forms will be supplied to the office in each school. PRINCIPALS shall transmit a copy to the appropriate ASSISTANT SUPERINTENDENT, the Administrator responsible for School Safety, the agent for the liability insurer, and the teacher involved.
    2. The BOARD shall provide at BOARD expense a standard type of liability insurance covering teacher's acts in performance of proper duties as a teacher. Insurance limits shall be $100,000 for each person and $500,000 for each occurrence. Such insurance program shall also provide an attorney to aid in the defense of any teacher in any civil or criminal action arising from an assault and/or battery on a teacher which occurs in connection with his employment or any disciplinary action taken against a pupil by a teacher where the teacher acted in good faith in accordance with the disciplinary policy of the BOARD. In the event of legal action, arrangements to obtain counsel shall be made through the ASSISTANT SUPERINTENDENT FOR BUSINESS SERVICES.
    3. The attorney and/or claims personnel designated by the liability insurer in accordance with the preceding item shall assist the teacher as follows:
      1. By obtaining relevant information;
      2. By accompanying the teacher in court;
      3. And by acting in other appropriate ways.
    4. A teacher assaulted in the performance of proper teaching duties and as a result is unable to resume work shall be compensated according to the worker's compensation provisions in Policy 8421, Item VI C 1 and 2 of the Negotiated Agreement.
  2. The BOARD carries adequate liability insurance that provides blanket coverage for all regular school employees.
  3. Athletic coaches and other staff members may transport students to school events with the permission of the PRINCIPAL, providing they comply with Board Policy 8350 and carry insurance in the amount of:
    1. $100,000 for one person;
    2. $300,000 for a group;
    3. $50,000 property damage.

    The BOARD pays the difference in premium between liability coverage of $15,000/$30,000/$5,000 and the $100,000/$300,000/$50,000 upon submission of evidence of such required amount to the ASSISTANT SUPERINTENDENT FOR BUSINESS SERVICES.

  4. A recipient of car allowance that is paid for by the BOARD is required to file with the ASSISTANT SUPERINTENDENT FOR BUSINESS SERVICES a statement that s/he has liability insurance in the amount of at least $25,000/$50,000/$10,000.
