POLICYNON-MEDICAL LEAVE OF ABSENCE 8905
Human Resources
  1. All requests for non-medical leaves of absence and extensions of non-medical leaves of absence must be approved or denied by the Superintendent or his/her designee.
  2. A request for a non-medical leave and extension shall only be granted for the following four reasons:
    1. Academic,
    2. Career Exploration,
    3. Childrearing, and
    4. Adoption.
  3. To be eligible to request a non-medical leave, an individual must: (a) be an Administrator of the Madison Metropolitan School District (District) at the time the request is made and (b) for the past three consecutive years, have worked as a full- or part-time Administrator for the District.
  4. All Administrators who request a non-medical leave or extension shall (a) fill out the non-medical leave form and provide an explanation regarding the circumstances surrounding the request for a non-medical leave or extension for academic, career exploration, childrearing or adoption, (b) sign the Non-Medical Leave of Absence Agreement and (c) (for an academic leave and an extension of an academic leave) submit a proposed academic plan and/or evidence of being accepted into an academic program. (Note: no career exploration leave or extension of a career exploration leave may be granted if the reason for the leave or extension is to facilitate the Administrator working as an administrator or teacher for another school district. All information related to requests for leaves and extensions shall be subject to verification by the Human Resources Department.)
  5. Upon the expiration of the non-medical leave or extension, should the Administrator fail to return to work after receiving notice from the Superintendent or his/her designee to do so, the Administrator agrees that by signing the Non-Medical Leave of Absence Agreement, the District may consider such signing the resignation of the Administrator which is effective as of the date on which the Administrator has failed to return to work as requested by the Superintendent or his/her designee.
    1. All non-medical leaves of absence, including extensions, for academic, career exploration and childrearing, shall be for one fiscal year with a maximum duration of two fiscal years, if an extension is granted.
    2. Requests for non-medical leaves and extensions for academic, career exploration and childrearing, shall be made between November 15th and December 15th prior to the July 1st date on which the leave or extension will commence. On or before the first January 1st that follows the above-referenced December 15th date, the Superintendent or his/her designee shall notify the Administrator of whether or not his/her request for a leave or extension has been granted. If granted, the leave or extension shall commence on the first July 1st after the request is made and end on the following June 30th. If the request for an extension is not granted, or if there is no request for an extension, then on or before the first January 15th that follows the above-referenced January 1st date, the Administrator shall notify the Executive Director of Human Resources of whether he/she will resign, retire or return to work. Should the Administrator not provide such notification, then the Administrator shall return to work as provided in paragraphs 9A, 9B, 9C, 9D, and 9E that are set forth below and may be subject to the provisions set forth in paragraph 5 above.
    1. Requests for non-medical leaves for adoption may be made at any time.
    2. Requests for non-medical leaves for adoption and extension for adoption shall have a total maximum duration of six months. If an extension for adoption is granted, such extension shall not extend beyond the total maximum six-month period for which the Administrator may be on leave for adoption.
    1. All non-medical leaves and extensions shall be without pay and the District shall not pay the costs of any benefits for the Administrator while such Administrator is on (a) leave, (b) an extension of the leave or (c) Administrative Surplus.
    2. An Administrator on a non-medical leave or an extension may continue to be covered by the District’s medical, dental, life and long-term care insurance if the Administrator makes a monthly payment in advance to the District for the cost of the premiums for such insurance.
    1. Except in those cases in which an Administrator is on a non-medical leave for adoption and extension for adoption for a period of six months or less, a position may not be held open for an Administrator on non-medical leave or an extension and, therefore, there is no guarantee that when the Administrator returns, he/she will be placed back into the position the Administrator held before he/she went on leave.
    2. Except as set forth above relative to Administrators on leave for adoption and extension for adoption for a period of six months or less, upon an Administrator’s return from leave or an extension, the Superintendent or his/her designee, in his/her sole discretion, shall place the Administrator into an appropriate vacant administrative position, if available, that is the same or lower position classification as the position the Administrator held prior to him/her going on leave of absence. The position should, to the extent possible, match the Administrator’s certification, training, ability, knowledge and experience.
    3. In the sole judgment of the Superintendent or his/her designee, should no appropriate vacant administrative position be available in which the Administrator can be placed when he/she is scheduled to return to work after the leave or extension, the Administrator shall be placed on Administrative Surplus until the Superintendent or his/her designee places the Administrator into the next vacant administrative position for which the Administrator is qualified, as determined by the Superintendent. While on Administrative Surplus, an Administrator shall not receive any compensation from the District, including salary and the payment of the cost of benefits, but the Administrator may pay for District benefits as described in paragraph number 8 B. herein.
    4. If there are two administrators who are returning from a leave or extension with similar qualifications to fill the next vacant Administrative position, the Superintendent will determine which administrator shall be offered the job and which administrator will be placed on surplus, if necessary.
    5. Should the Superintendent place an administrator in a vacant administrative position that is in a lower grade level on the Administrative Salary Schedule than the grade level of the Administrative position he/she held before going on leave, then such Administrator will be paid at such lower grade level.
  6. No more than two (2) administrators may be on a non-medical leave and/or extension at any time. Should more than two requests for leaves and/or extensions be submitted, the requests and/or extensions will be reviewed and granted on a first come, first served basis.
  7. An Administrator who has been granted a non-medical leave shall not be eligible to request another non-medical leave until such Administrator has worked as an Administrator for the District for three consecutive years after the date on which the previous non-medical leave or the extension has ended.
  8. No leave or extension will be granted that allows an Administrator to go from full time to part time work with the District.
